New NJDEP required Tree Ordinance

Public comment for a new ordinance regulating tree removals and replacement planting requirements will be heard during the public hearing at the June 11, 2024 Township Committee meeting for Township Ordinance Chapter 16, Shade Tree Protection.

The New Jersey Department of Environmental Protection requires all New Jersey municipalities to adopt a new ordinance regulating the removal and planting of replacement trees.  Bernards Township’s current ordinance exempts properties from permit requirements if the lot is 3 acres or less.  This exemption is eliminated with the new ordinance and instead provides for exemptions for certain hazard trees.  The new ordinance also replaces the Township’s replacement tree requirements with the NJDEP’s planting schedule.  The new ordinance can be found here: Chapter 16 Tree Ordinance
